Lodging an appeal

 

Appeals under the Strata Titles Act 1998 are to be lodged with the Recorder of Titles. The fee is $252.00.

All other appeals are to be lodged in writing with the Tribunal. Suggested forms are available from the Tribunal and this web site. These forms are preferred but not mandatory. Fees are payable with lodgment of the notices.

The time for appealing is set by the Act under which your appeal is brought. If that Act does not set the time then the period is 14 days from the date on which the decision was posted to you or otherwise served on you.

Joining as a party to an appeal (Practice Direction 4)

Section 14 of the Resource Management and Planning Appeal Tribunal Act 1993 sets out who are parties and who may apply to join as a party to an appeal. That Section limits who may apply to be joined, what entitles them to apply, and what arguments they may present at the hearing of the appeal.

Apply as early as possible and before the directions hearing (see below).

Notification of appeals (Practice Direction 3.4)

 

The Tribunal notifies each party to an appeal, by letter.

A notice of the appeal and of the date for the directions hearing is put in the Public Notices section of the local newspaper.
