Contested hearings

 

For these hearings the Tribunal normally has a Chairperson and two other members. The Chairperson is normally a legal practitioner, who runs the hearing. The other members of the Tribunal are selected for knowledge and experience in the issues raised by the appeal, e.g. scientists, architects, engineers, planners.

 

Addressing the Tribunal at a hearing

  • You do not need to stand.

  • Address the Chairperson as "Mr or Madam Chairperson" or "Sir or Madam".

  • Address Tribunal members as "Sir or Madam", or by their title and surname.

  • Address the Registrar or Deputy Registrar as "Registrar".

 

Sequence of cases at a hearing

  1. The person who applied for the decision appealed against, for example the developer or active party.

  2. The decision making authority, e.g. the Council or relevant ministerial authority.

  3. Any other parties to the appeal.
